Doesn't pass muster. These are problems with the patriot act passed by congress.
I strenuously object to the presumption behind the accusation. I sense that you feel that Ashcroft is supposed to arbitrarily act as a judge and enforce only the laws he agrees with and not enforce the laws, enacted by congress and signed by the president, that you find objectionable. That type of "Texas Cowboy" mentality will destroy a society based on law. When a public servant takes office, they swear to uphold the law. Challenging a law in court is the acceptable way to change bad laws. For any government official to simply reject a law because they do not like it should be grounds for prosecution.
John Ashcroft is in the unenviable position of defending the laws passed by congress in courts to the best of his ability. He is also charged with enforcing those laws until they are overturned. Given who he is, he takes those responsibilities very seriously. He gave his word. That means a great deal to John Ashcroft.
