If you want mtime preservation mandated, someone needs to come up with
a fix for all those packages that end up dumping duff mtimes on the
system... There's progress towards that on the bug, but it's not there
yet.

No, an EAPI bump is necessary. Older (post-EAPI) Portage versions do
something different, so any ebuild relying upon particular behaviour is
already broken.
