The trouble is he wasn't working for CSIRO, but I helped review the patches. We
cc'ed the manager etc. from the organisation, but didn't get any response (re:
contribution agreement). If I modify them, would I be able to submit these
files, and put both our names down (with respective organisations)? Otherwise
I'll have create new tests, which is fine I guess, but it's a shame to waste
the effort :).

If he was doing this work under contract (or as an employee) then he should be
covered by the organisation contribution agreement. Or you could have a manager
sign on his behalf.
It would be kind to mention him in javadocs with a @author Geoff Williams
