Yes indeed, GeoTools 10 has a new implementation of the shapefile datastore. I think you must be on to something! The first step will will be to report the issue in the issue tracker, and then start up a conversation to see if we can figure out where the problem is occurring.

(I only test the docs when I get a chance to run a geotools training course, so they have not been tested with this new implementation of shapefile yet).

The old version of shapefile datastore is available as gt-shapefile-old if you want a temporary fallback.
