If i can see it from a public right-of-way, i can take a picture of it and show others. There have been some attempts to interfere with this, but it's a pretty tough battle in most cases, not counting locations of "national security" of course

Anyone can definitely trademark the unique and business-purposed unique features of a place they control, and you can't go flaunting that without permission. McD's Golden Arches in your board game? I think not.
