The basic problem is that the Californian Law, which is often cited as
being to protect Agriculture, is actually to protect the environment. It
is part of the Wildlife and Game legislation, not Agriculture
legislation. But is policed by the Department of Agriculture border
stations.
The law lists those animals that can be kept. If you are not on the
list, you cannot be kept without a license. Hamsters are on the list,
Gerbils and Ferrets are not. It all depends on what the legal draftsman
thought were pet species at the time the law was written. Other species
can be added to the list, but that is a major undertaking.
I am not aware of any other states other than Hawaii and California that
ban gerbils as pets.
