In addition, though I've not read the article, it's almost a dead cert that it glosses over the distinction between watching a broadcast and 'downloading' to keep (as opposed to taping a broadcast which is the loophole GiP falls under).

As new rights deals are formalised old deals are always being reviewed; modern contracts / licenses cover all formats, often for perpetuity, while old deals will have no provision for future formats like streaming/downloads. Thus, new licenses for archive material will have to have been negotiated with additional royalties offered.

The upshot of this may also be that airplay agreements might have been renewed in conjunction, allowing programmes that had reached their maximum number of terrestrial broadcasts to get a new tranche of airings - so they may appear on the iPlayer soon. (This is all conjecture, but not unreasonable.)

Of course, I should have made it more clear that I was referring to
archival, and not current material
