As I understand it, if MV is a CLEC or they buy from a CLEC (Covad, et. al.) they're still in the game - otherwise they're subject to Verizon's whim under the new FCC rule. And why would Verizon have pushed for the new rule if the status quo were acceptable?

But as far as Earthlink and Comcast, I'm pretty sure the FCC never mandated open access to the cable plant, so Earthlink and Comcast must have worked out a mutually acceptable deal.
