Verizon is the visible face for FIOS, so the suit was launched against them. I assume that in the process of discovering where things came from, the plaintiffs decided that since Verizon is redistributing Actiontec's routers, it would be sufficient for them if Actiontec would provide the GPLed sources (which they were not doing for most of 2007) rather than Verizon.
