You have quoted the "Reply Comments of the Library Associations" which is a wish list, not the law. The law is going to shaped by various cases, but it's clear that the notion that all copies made under permission are subject to first-sale is unlikely to be correct. For example, various services exist which permit the downloading of songs, and set a limit on the number of devices to which that song may be copied.
