If the sources did not build or work, the first user trying to do something with them would notice. If they build and work, there is little point to make them build and work from different sources, maintaining two trees with different functionality. Calling something intentionally different a corresponding source without it being so in order to fulfill licensing conditions would be active fraud, not just negligence. So you are claiming that Actiontec likely does parallel development of equivalent functionality for the sole purpose of being able to be liable for fraud.
