Since citation of a limited amount of material for criticism is fair use in the print world, and, at least in US copyright law this extends to all formats unless restricted by contract, all that is necessary to do is to specify that the rights of fair use cannot be limited by contract. (It's changing one word, but of course a major policy reversal).
