Stop illegal development: be an alert and participative citizen
for the proper development of Goa. Silence does not help.
Goa Bachao Abhiyan (GBA) calls upon you to stand up against
developmental activities without proper No-Objection Certificate
(NOC) such as:
HILL CUTTING: Any land having a gradient of 1:10 or more needs
to have a contour plan and no construction on slopes of 1:4 or
25%. Cutting of land more than 1.5 metres is not allowed and is
taken as hill cutting.
THE LAW ON HILL CUTTING: Section 17A of the Goa Town & Country
Planning Act 1974 prohibits this without obtaining prior
permission from the Chief Town Planner. The Town & Country
Planning (TCP) Department is the authority concerned.
FILLING OF LOW-LYING FIELDS: Any land below 50 cms or more from
the adjoining ground level.
THE LAW: Section 17A of the Goa Town & Country Planning Act 1974
prohibits this without obtaining written permission from teh
Chief Town Planner. The Town & Country Planning (TCP) Department
is the authority concerned.
CUTTING OR BURNING OF TREES: Section 8 of the Goa Preservation
of Trees Act prohibits the felling, removal or disposal of trees
without prior permission of the Tree Officer. The Forest
Department is the concerned authority.
DEVELOPMENT OR CONSTRUCTION IN CRZ AREAS: No development zones
are (in case of the sea) upto 200 metres from the high tide
line. In case of rivers and creeks, upto 100 m or half the
width, whichever is less. The Coastal Regulation Zone (CRZ)
Notification 1991. The Goa Coastal Zone Management Authority
(GCZMA) is the authority concerned.
DESTRUCTION OR FILLING UP OF MANGROVE AND TIDAL BACKWATERS: The
Coastal Regulation Zone (CRZ) Notification 1991. The Goa Coastal
Zone Management Authority (GCZMA) is the authority concerned.
WHAT YOU can do to stop violations:
Check the board on site. Any development or construction site
must have a board prominently displaying (a) Name of the
developer (b) Date of commencement of work (c) NOC from the Town
& Country Planning Department (d) Conversion sanad from the
Collectorate (e) Construction license from the village panchayat
or the municipality (f) In case of the activities mentioned
above, NOC from the concerned authority (date of issue and
validity period of all permissions need to be mentioned).
If there is no board or any of the requisite
information is not displayed, immediately contact the
following nodal officers, who are responsible to
prevent and stop the above violations:
Deputy Collector/SDM of your taluka: They will carry out a site
inspection and also verify if permissions have been granted. If
the activity is illegal, a stop work order should be issued
forthwith and the police authorities will be informed to enforce
the order and initiate routine patrolling to avoid restart of
the illegal work. Inspite of the order, if work is restarted,
the police may seize plant and machinery and seal the premises,
pending completion of the inquiry.
During non-working hours, Sundays and public holidays: File
complaints with the police authorities at the respective police
stations or dial "100" (control room), who, in turn, will act
and report the matter to the nodal officer.
All verbal complaints to the Deputy Collector (taluka level)
need to be followed up in writing, with copies marked to the
District Collector, concerned authorites (TCP, GCZMA, Forest)
and the Chief Secretary.
Please ensure that your written complaint is registered with the
concerned department for the purpose of record and follow-up.
Use the Right to Information Act to gain further information and
documents to strengthen the case against any illegalities.
