Sharma Secretary to Shri Eduardo Faleiro, MP SPECIAL MENTION The Supreme Court of India pronounced itself on the National Curriculum Framework for School Education and related issues on September 12, 2002. The three-judge Bench delivered three separate judgements in this case being Writ Petition No. 98 of 2002. The Court reiterated the well established propositions that it had a limited jurisdiction to intervene in the implementation of a policy; that it is not in the province of the Court to decide on the good and bad points of an Education Policy and that it is for the Parliament to take a view on this subject. Two of the learned judges also directed the Union of India to consider the matter of filling the vacancies in the membership of the Central Advisory Board of Education (CABE) and convene a meeting of CABE for seeking its opinion on the policy and the Curriculum. In the above circumstances I urge Government ? to fill the vacancies in CABE and convene its meeting expeditiously; to appoint an independent body of experts to evaluate the new textbooks in Social Sciences and not to introduce them in schools until such evaluation is complete; and to obtain parliamentary endorsement of the changes that Government has made and proposes to make in the National Education Policy which was unanimously approved by Parliament in 1986 and which is still in force.
