Use of Saligao plateau as garbage dump site challenged in court
------------------------------------------------------------------------------------

The Saligao Civic and Consumer Cell (SCCC) has gone to court challenging
the use of the Saligao plateau as a garbage disposal site by the Mapusa
Municipal Council and the Saligao Panchayat.

The petitioner challenged the selection of the garbage disposal site on
the top of Saligao plateau in the midst of a forest plantation raised by
the Forest Department, claiming that the decision to locate the disposal site
in this inappropriate area was made without following the procedure laid down
by law, particularly the provisions of the Municipal Solid Waste(MSW) Rules
2002, issued under Sections 3,6,25 of the Environmental Protection Act 1986.

The area in question comprises Survey No 47 of Calangute and 112 of Saligao,
adjoining one another.The petitioner has claimed that the site in question
is on a high, bounded by valleys which have springs and wells supplying water
to the villages, including the Salmona spring, which has been developed
as a tourist destination.

The petitioner has also stated that guidelines for garbage dumps do not allow
or recommend locating such dumps in high areas due to the obvious dangers
of leachates from such areas getting into the water supply below.They have
prayed for a writ directing the government to implement the provisions of the
MSW Rules 2000 in respect of dumping of garbage on the suit property.

They have also prayed that pending the hearing and final disposal of the petition,
the Mapusa Municipal Council be directed to produce and implement plans for
improvement of the site as per the requirements of schedule I of MSW Rules 2000.

They have also prayed that the Calangute panchayat and Saligao panchayat
be restrained temporarily from dumping any garbage on the property,
until the final disposal of the petition.
