Question 12: My father was from Goa and owned some properties in Goa. Now I am considering retiring in Goa. When I came down to Goa to my surprise my house was occupied by some persons whom I don't know. How can I evict them from the house? Can they make a claim of tenant/mundkar?

Adv. T. Jaques: Since you claim that some one is occupying your house without permission you will have to file a suit against the same person to evict him from your house. The occupant may claim tenancy rights or mundkarial rights depending upon who has established such a relationship, which may not be binding on you. However the time that he is in occupation will be relevant vis-a-vis the person who was looking after your house during your absence. In any event your Advocate appointed to take care of the matter will definitely guide you before filing the case.
