Dear Sir, Inspite of writing several letters to Mamaladar since last year no action is taken again I have sent a reminder with a copy endorsed me by Mamladar but so far no action has been taken as Police says that a lady witness is not eligble to stand as a witness. My house is getting ruined in the rains because the owner of the 3 mango trees says he is a BIG AND GENEROUS BADKAR. All of us are disturbed by such remarks as no authorities are willing to resolve the matter. Below are the letter written to Mamladar

REgards C.Fernandes March 21, 2006 To Mamladar Mapusa, Bardez, Goa-403 517 Subject:- Three Mango trees located on the West Side of our House no.811 belonging to Mr. Ajodore Dsouza, Porta Vaddo, Siolim, Bardez, Goa. Dear Sir, In continuation of letter dated April 11, 2005, we would again pin point the grave problems faced by inmates residing in House no.811. Each of these three (3) Mango trees have a height of about 8 metres and branches are overhanging on our house roof from the West Side, this matter was now and then been verbally told to Mr. Ajodore Dsouza about the nuisance of these trees which he fails to understand about trimming the branches of trees or to repair the damage. He gives a deaf ear to our pleas. During Monsoon, these trees create havoc on account of the Mangoes which fall on our tiles. When there was heavy rain in the past 2 weeks back, tiles broke due to mangoes falling on our Mangalore tiled roof. When it rains, water pours through the broken tiles creating lot of damage to our walls, wooden beams, floors, furniture, fridge, etc., which is a monetary loss. As a result the entire floor gets wet and flooded upto knee level. My aged mother who is more than 75 years old is bearing this grave difficulty and is psychologically effected due to such problems. This matter was brought repeatedly to the notice of Landlord (Ajodore Dsouza) requesting him to be compassionate to us by replacing the broken tiles if he cannot trim the branches but he refuses to believe saying that nothing is wrong and openly says that they are big generous Badkars in Goa which is really humiliating to us but he just ignores our pleas. We have yearly maintenance for our tile roofing but some time when we are urgently in need of tiles from the Market we are unable to procure due to shortage of tiles and labour in such a scenario. Another nuisance is huge Wild monkeys coming in a groups of six or more from the nearby forests hang on these trees to eat the fruits and jump on the roof tiles causing a great damage to the roofing which in turn affect us psychologically and financially. This matter was also brought to the notice of the Siolim Panchyat but no action is taken by them. I have some photographs which was clicked long time back which you can glance and get a clear scenario of the situation (Xerox copy) enclosed for ready reference. We feel the Big generous Badkar is playing with our patience, time and money. Kindly let us know how we can be protected in the event of the great damage caused to our house. Dear Sir, In continuation of my letter dated 21st March, 2006 and your response of letter no.JM-II/MAG/133/Cr.P.C./2006 dated 04/04/2006 to The Police Sub Inspector, Siolim Police Outpost Station, Siolim, Goa with a copy endorsed to me for which I thank you but regret to state that so far no action has been taken in this matter and we are all perturbed by the grave silence on this matter. I further made enquiries at the Police Station and met Mr. Naik who is in charge and he assured me that he will take action but so far no action is taken. As monsoon is unpredictable, we fail to understand why Mr. Ajodore Dsouza Resident of Porta Vaddo, Bardez, Goa has not been asked to trim his branches as it is his responsibility who claims to be a Big and Generous Badkar to protect our house against the dangerous branches of the three Mango trees belonging to him because all our requested pleas to him have fallen on deaf ears. Our dining room is littered with dry leaves and mangoes falling on the tiles cause breakage to the tiles which is a big loss to us. Even during night the mangoes fall on our tiles with a such loud bang that my ailing mother who is more than 75 years gets mentally effected psychologically and emotionally as her sleep gets disturbed as well as all the inmates residing in the house. We have sleepless nights when mangoes fall with such great velocity at midnight causing disturbance to all of us as well as breakage of tiles. Are we to suffer on account of his trees as now monsoon season is very near we will have to face a tough and difficult time if no proper disciplinary action is taken against Mr. Ajodore Dsouza as we noticed he is not at all serious about this matter. I have again taken photographs where the branches of the trees hanging dangerously over our house because if externally the photographs are noticed, then imagine how much internal damage is done to us. I again appeal you to kindly look and intervene into the matter before it is too late. Kindly let us know how we will get protection for our house before the monsoon.
