PMCA & GOA FOUNDATION VERSUS HOTEL GRAND HYATT ---------------------------------------------------------------
People's Movement for Civic Action (through its general secretary Patricia Pinto) and the Goa Foundation Vs. the Goa Coastal Zone Management Authority; Panchayat of Curca, Bambolim and Talaulim; State of Goa, Chief Town Planner; Ministry of Environment & Forests; Goan Real Estate and Construction Ltd, Aldeia de Goa; Goan Hotels & Clubs Pvt Ltd, Goregaon, Mumbai. "This case is of brazen, wholly illegal construction. The petitioners have sought the rule of law. The respondent No. 6 [Goan Real Estate and Construction Ltd, Aldeia de Goa, Next to Goa University] has breached the rule of law blatantly. To grant or refuse the reliefs in the peition upon a clear case being made out by the petitioners and to set aside or affirm the orders of various governmental authorities who have sided and backed the construction of the respondent No. 6, I must be guided by a similar exercise undertaken by the Supreme Court not very long ago ... which [in another case]... not only frowned upon, but deprecated and refused to countenance unauthorised and illegal construction of the petitioner and ordered the demolition of the entire illegal portion."
