"CHAI" SOLVING SUPREME COURT MALAISE?
The four senior most judges stuck their necks out to called an unprecedented
press conference to publicly state "Unless this institution is preserved,
democracy will not survive!". We are now given to understand that it was only a
matter of arbitrary use of power by the CJI for by-passing seniority to form
benches allegedly to pre determine outcome of politically sensitive cases.
Matter sorted out over a cup of Chai, and it is back to business as usual. All
other specific criticism by eminent experienced Supreme Court senior lawyers
like Dushyant Dave and Prashant Bhushan openly exposing the corruption and
politics in the Indian judicial system are brushed under the carpet! The public
confidence and universal faith in the Apex court has been shaken and needs
quick transparent and accountable fixing, especilly when we have a majority
authoritative government that has decimated all opposition and taken
over/controls institutions like the RBI, enforcement agencies, legislature and
executive. The government can be challenged only through the law which they are
increasingly abrogating to themselves as they wish. Kuldip Nayar says "Not long
ago judgements were pro peaple, pro weak, pro environment. Today the judiciary
has tended to side with riches, power and those who destroy the flora and
fauna. If the Supreme Court judges think about themselves and not the law,
democracy can be in danger". Parliament and government must stay far away from
this dispute between judges and if judicial independence with honor, integrity,
decency and decorim does not survive this crisis, our nation is in deep trouble!
