Hi Ruby I believe the UK Government will appeal against the court ruling on the grounds that although the entry into the UK was based on the idea of Highly Skilled Migrants to undertake work where there are skills shortages, many of the HSMs are working in unskilled jobs, for a variety of reasons, such as taxi drivers, serving in eating places, petrol stations etc. This is true. I know of several myself, (including three Indian trained doctors who work at my local petrol station) who have been informally seeking advice from some of us ethnic UK old-timers on how to better their work circumstances.
The outcome of the appeal will be interesting especially at a time when there is growing expression of unease about the numbers who have come into Britain for employment recently. My personal take on this issue is that the UK Government traditionally muddles its way with blinkers on, on many issues and this is but one such example. The HSM policy was definitely not well thought out in concept and application and the Govt has been caught with its proverbial pants down.
