The Supreme Court is for final Judiciary decision. But I am afraid that they can take up matters related to supervisions like DGPS position system, which is a technical matter but I am sure SC can always direct some Govt agencies who can do a better job in Delhi like NIO ( CSIR) or elsewhere in the country, who can be directed to do this job pertaining to Mining. Claude Alvares must pursue with the matter vigorously.

The Goa Foundation, in an additional affidavit filed before the SC, stated that instead of appointing an independent agency to carry out this exercise, the Goa government has permitted the mining companies themselves to conduct the DGPS survey. The petitioner, Claude Alvares, also said that this is obviously done to pre-empt any action from the court or any committee appointed by it. The state government has permitted the mining companies to demarcate their own lease boundaries so that they can protect themselves from charges of having gone beyond their boundaries in their drive to excavate ore, the affidavit stated. Petitioner has expressed complete lack of faith and trust in this process, and stated that 'this is equivalent to having the thief put in custody of the stolen goods'. Petitioner submitted that this exercise should have awaited proper demarcation under supervision of the court or the CEC, as was done in Bellary, Karnataka. It is in bad taste that the exercise has been carried out without the approval and consent of this court, Alvares has stated.
