Here are the TOS for the Web Search API, formerly known as the AJAX Search API. You will want to note that this API was deprecated November 1, 2010. While Google's deprecation policy is says that they will support the API for 3 years after that date, it also notes that they will do so only as long as it is commercially reasonable.
