Hi David: There is no contradiction here: Monitored messages with the Audit API are always provided to the destination user in the form of text file attachments.
The "BCC" simply refers to which type of destination address field is used to route the copy of monitored email messages to the recipient. In the case of the Audit API, the monitored user under legal audit never knows that their emails are being forwarded to the destination user. For more on different methods of BCC, see RFC 2822<http://tools.ietf.org/html/rfc2822#section-3.6.3> .
