In that case I can be categorically certain that you will need a Premier licence. If you cannot meet all of the free Terms, then you need a Premier licence as the Premier licence allows some of the free Terms to be varied: for example 9.1, in order that the implementation doesn't need to be public. I don't know whether it also allows 10.8 to be varied.
