Google Health is not a covered entity under HIPAA, because as I understand
it to be regulated under HIPAA it has to be a third-party or a provider who
is managing the information. In the case of Google Health, the patient is
the one who controls access, so there is no need for HIPAA to regulate
privacy or security.

With that said, I imagine this was carefully decided by Google's lawyers and
is discussed in the Google Health documentation. I would doubt this will
change - look instead whether HiTech or newer legislation will expand to
cover PHRs.

Do google health have any plans to be a Hipaa compliant in near
future? If i am not wrong, google's premium email service is a hipaa
compliant then why not Google health? I am very keen to know if google
have any plans. Please let me know. Thanks.
