*Another judicial slap to Mayawati* Kajari Bhattacharya LUCKNOW, 13 SEPT, 2009: Already reeling under a Supreme Court rebuke over building extravagant parks and memorials, the Mayawati government received yet another jolt when the* Allahabad High Court quashed a May 2008 Uttar Pradesh government notification that ordered forfeiture of a book, Jati Raaj (Rule of Caste), about caste-based politics practised in the state by political parties. * A Special Bench of three Judges, headed by Justice Mrs Saroj Bala, ruled in favour of two petitioners ~ Mr Mohandas Mishra Dheeraj and Mr Anil Kumar Singh ~ on Friday. A senior Provincial Civil Services officer, Mr Lakshmi Kant Shukla, had written the book that spoke out against caste-based politics practised widely in the state. Mr Shukla was placed under suspension while he was special secretary in the state Social Welfare department. The state government had forfeited the book under Section 95 of the Criminal Procedure Code, which stipulates that the government can forfeit any book or article that is punishable under Sections 153 A and 295 A of the Indian Penal Code (promoting animosity between two communities based on caste or religion). Speaking to The Statesman, Mr Satya Narain Shukla, retired IAS officer and senior advocate, who argued the case on behalf of the petitioners, said: “All this while readers were deprived from reading this book that also contains accounts of efforts by the writer to make available to penurious students who fall under the General or OBC category, b*enefits that accrue only to SC/ST students.”* He added that the HC ruled the said book contained nothing that could be considered punishable under Sections 153A and 295A of the IPC. “As a result of the state government notification, it was an offence to read or own Jati Raaj.
