1       The Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement (Amendment) Bill, 2015 seeks to Amend
the Act of 2013 (LARR Act, 2013).
2       The Bill creates five special categories of land use: 1. defence, 2.
rural infrastructure, 3. affordable housing, 4. industrial corridors,
and 5. infrastructure projects including Public Private Partnership
(PPP) projects where the central government owns the land
3       The Bill exempts the five categories from provisions of the LARR
Act, 2013 which requires the consent of 80 per cent of land ownersto
be obtained for private projects and that of 70 per cent of land
owners for PPP projects.
4       The Bill allows exemption for projects in these five categories from
requiring Social Impact Assessment be done to identify those affected
and from the restrictions on the acquisition of irrigated
multi-cropped land imposed by LARR Act 2013.
5       The Bill brings provisions for compensation, rehabilitation, and
resettlement under other related Acts such as the National Highways
Act and the Railways Act in consonance with the LARR Act.
6       The Bill changes acquisition of land for private companies mentioned
in LARR Act, 2013 to acquisition for 'private entities'. A private
entity could include companies, corporations and nonprofit
organisations.

Cabinet clears re-promulgation of land ordinance

The land bill passed by the Lok Sabha and pending before the Rajya
Sabha has no chance of being cleared before April 5.

The Union Cabinet late Tuesday decided to recommend re-promulgation of
the land acquisition ordinance incorporating nine amendments that were
part of the bill that was passed in the Lok Sabha earlier this month.

The decision was taken at a meeting of the Cabinet presided over by
Prime Minister Narendra Modi as the bill passed by the Lower House and
pending before the Rajya Sabha has no chance of being cleared before
April 5, 2015.

Now the recommendation will go to President Pranab Mukherjee, who is
expected to reissue the ordinance in time before April 5, 2015 when
the previous ordinance will lapse.

Sources said that it will be a new ordinance that will incorporate all
the nine amendments brought in Lok Sabha saying it cannot be different
from the bill already pending.

The pending measure, titled Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement
(Amendment) Bill that was passed in the Lok Sabha sought to replace
the ordinance that was promulgated in December 2014.

The ordinance should have been cleared by Parliament before April 5,
2015 if it was to subsist. But the government faced a hurdle in the
Rajya Sabha, where it could not get the bill to replace it cleared
because of lack of numbers.

The opposition was not in a mood to oblige the government and in fact
mounted a strong campaign against it. Led by Sonia Gandhi, the
opposition parties demanded the passage of the original land bill that
was passed during the UPA regime.

Brushing aside opposition to the ordinance, the Cabinet Committee on
Parliamentary Affairs on Friday decided to prorogue the current
session of the Rajya Sabha paving the way for reissuing it. On
Saturday, the President prorogued the Upper House.

Under the Constitution at least one of the Houses has to be prorogued
for the government to issue an ordinance. Parliament is currently on a
month-long recess after the Budget session that started on February
23.

The land ordinance was among the six executive orders issued by the
government in the inter session period. While five of them were
cleared by Parliament, the land measure is stuck.

Once it is re-promulgated, it will be the 11th ordinance to be issued
by the Modi government.

Teen Bigha (West Bengal): Government on Tuesday appealed to the
Opposition to support the land acquisition bill and help in its
passage in Parliament while amendments in the interest of farmers
could be taken up later.
"Let the land acquisition bill be passed first. If it proves in future
that it is hurting farmers' interests, we can always amend it.
Government is ready to do that. But let it be passed in Parliament
first," Home Minister Rajnath Singh told PTI in West Bengal.

He said the welfare of farmers and development of villages were very
much necessary for the country as without comprehensive development of
farmers, there cannot be any progress of India.
Singh said that the NDA government was committed to the development of
rural communities in the country.
"I would like to appeal to political parties to support the land
acquisition bill and allow its passage in Parliament," he said.
The land acquisition bill could not be passed in Rajya Sabha as most
of the opposition parties are opposed to it and the government does
not have the numbers in the Upper House.
The government had promulgated the land acquisition ordinance in
October 2014 and the legislation was supposed to be passed by
Parliament by 5 April.
Since it did not happen, the Budget session of Rajya Sabha was
prorogued to facilitate the re-promulgation of the ordinance.
While the bill, providing for amending the Act of 2013, cleared Lok
Sabha earlier this month, it got stuck in Rajya Sabha with entire
opposition uniting in the House where the ruling NDA is in a minority.
An ordinance has to be converted into an Act through passage of a bill
in Parliament within 42 days or six weeks from the day a session
begins after promulgation of an ordinance.
If the government wants to keep the ordinance in force, it will have
to re-promulgate it before 5 April, which is the 42nd day since the
Budget Session began on 23 February.

Party's key meet in Bengaluru will steer clear of economic resolutions
NEW DELHI, MARCH 31:
The contentious Land Acquisition Bill will be the focus of
deliberations at the first meeting of the BJP's newly-constituted
national executive under party president Amit Shah in Bangaluru on
April 3 and 4.

The BJP's constitution dictates that the national executive will meet
every three months.

However, the party has not held a routine national executive session
for more than a year since January 2014. A session of the national
council was held in August 2014 to ratify the appointment of Shah as
party president.

But Shah has so far not presided over any meeting of the party's
national executive.

The first session of Shah's national executive promises to be as
different from the past as the functioning of the new president in
that there will be no economic resolution.

The practice so far was for the executive to deliberate over the
political and economic situation of the country and adopt resolutions
on the same.

Foreign policy
But in the upcoming executive, there will be no economic resolution.
However, there will be a resolution on the foreign policy initiatives
of Prime Minister Narendra Modi.

A drafting committee that includes party vice-presidents Prabhat Jha
and Vinay Sahastrabudhe along with general secretary Ram Madhav is
believed to be drafting the political resolution as well as the one
dealing with foreign policy initiatives of the new government.

Modi has placed a strong thrust on his foreign engagements and has
been widely praised for his focus on the neighbouring countries. In
the light of the question mark that had hitherto been placed on his
international acceptability, the BJP is naturally keen to project the
Prime Minister's success with his foreign policy initiatives.

The government's focus on the Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement
(Amendment) Bill, 2015 will form a major part of the political
resolution.

It is believed that a presentation will be made to the national
executive on the proposed amendments to the Land Acquisition Bill. The
presentation will be mostly likely made by a senior member of the
national executive, preferably with a rural background.

The BJP is facing stiff opposition on the ordinance that introduced
these amendments. The ruling party does not have a majority in the
Rajya Sabha, where a united opposition is determined to block the
amendments.

The Centre has thus decided to re-promulgate the ordinance on April 5
and has already prorogued the Rajya Sabha for the purpose.

While both Modi and Shah with senior ministers and MPs have been busy
canvassing popular support for the amendment Bill, it is important
that the party understands the import and the reason for pushing ahead
with this particular legislation which is being widely opposed.

A rally in the national capital on April 19 against the Narendra Modi
government's land acquisition policy may turn out to be the first
public appearance of Congress vice-president Rahul Gandhi after his
expected return around mid-April from a two-month long sabbatical at
an undisclosed location abroad.

During his absence, party president Sonia Gandhi mobilised public
opinion and united the opposition against changes made by the Modi
government to the 2013 land acquisition law, particularly the dilution
of the provision that mandated farmers' consent ahead of land
takeover.

Mr. Gandhi had cut his teeth in agitation politics in 2011 by
protesting against forcible land acquisition, and the party is hoping
that there is a public mood against the dilution of the law that it
can ride on.

"We hope Rahulji will be there," a senior party functionary said.

The caution is understandable: senior party leaders were taken by
surprise when, on the opening day of the Budget Session of Parliament,
they learnt that Mr. Gandhi had gone abroad to "introspect" on the
state of the Congress, thus missing the entire first segment.

"Every senior leader will take part," said Congress general secretary
Digvijaya Singh, when asked whether Mr. Gandhi's participation was
confirmed.
