We don't and haven't ever had a way to do sound only when the sending
application is in the background.  However, Growl 2.1 will add a ton
of power via the new rules scripting system, including potentially
this kind of behavior, although I haven't experimented with that kind
of determination, but it should be possible.  Further, we could add
this as an option to the sound action itself, but it wont make it for
2.1, since its in localization, and we don't like adding strings
during that unless absolutely necessary.

As for the split tab thing, we had to make changes when we introduced
actions to both the backend and UI, and it was decided for better or
worse to move sounds out into an action.  Growl 2.1 will be improving
it so that if you select a sound in the sound action, it will change
the name of the action to the sound name, making it easier to know
what sound you've selected.
