Jamir bypassed Constitution: Parrikar

Panaji Feb 2: The outgoing Chief Minister, Mr Manohar Parrikar today termed the dismissal of his government by the Governor, Mr S C Jamir by withdrawing his pleasure to it under Section 164 (1), as unconstitutional and irrational and described the procedures as bypassing of the Constitution.

Addressing a press conference at the Bharatiya Janata Party headquarters in the city later in the evening, Mr Parrikar said the Governor had shown disregard not only to the assembly but also to his own decision of convening a special assembly session for �floor test� and basing his future decision on the report of the Speaker, Mr Viswas Satarkar on the proceedings of the House.

�The Governor could not even wait for the Speaker�s report,� he lamented.

Mr Parrikar said that a Raj Bhavan staff member, who arrived at the assembly complex at 5.45 p.m., was carrying the government dismissal order typed, approved and signed at around 4.30 p.m., half-an-hour before voting on the trust motion took place. �It is quite clear that the dismissal of the government was pre-planned,� he alleged.

He informed that the Independent MLA, Mr Filipe Neri Rodrigues had neither been disqualified nor prevented from voting by the Speaker; the Speaker, in fact, had asked him to withdraw from the House under Section 289 (3) of the Constitution, which states that �the Speaker can remove any member from the House for his disorderly conduct�.

Mr Parrikar said the Speaker had summoned Mr Rodrigues in his cabin thrice during the recess for discussing the disqualification petition filed against him. However, Mr Rodrigues chose to ignore the invitation, and the Speaker might have assumed that as a �disorderly conduct�, he noted.

Speaking about the future course of action of the BJP, he revealed that the state unit of the party was in constant consultation with central leadership and would soon draw up its plan to face up to the situation. The central BJP leadership had been shocked by the decision, the outgoing Chief Minister observed.

The party has taken a serious note of the Governor�s decision and ignoring this decision would be allowing a bad precedent to set in politics, which could harm governments in other states in the future, he remarked.

Mr Parrikar also said that public agitation, approaching the court of law and seeking the redressal of the President, Dr A P J Abdul Kalam were some of the steps which the party could take to counter the decision. �In fact, on two occasions in the past, the President had reverted the decision of the Governor as regards dismissal of the state government; once Mr Bhanu Prakash Singh dismissing the Wilfred de Sousa government in Goa, in 1990s and on second occasion, Mr Ram Lal dismissing the N T Rama Rao government in Andhra Pradesh, in 1980s,� he pointed out.

Mr Parrikar predicted that the new government would be in minority and that the assembly election is round the corner.
