POLITICS: SpeakerÂ’s ruling absurd: Parrikar

BY HERALD REPORTER
PANJIM, JULY 13, 2005

-- Opposition Leader, Manohar Parrikar described the ruling of the Speaker Francisco Sardinha as absurd, defective and malafide.
He said moving  an application for ad-interim order on July 12 clearly showed the mal-intention of the petitioner (Pernem MLA Jitendra Deshprabhu).
He said interestingly, there was no such application to restrain the Cortalim MLA from participating in the election of the Speaker and Deputy Speaker on July 8.
Parrikar stated that the Supreme Court has in some rulings made it clear that the election procedure cannot be manipulated or amended once the election schedule is notified.
For the Rajya Sabha elections, this was done on June 27.
He said when the electoral college is finalised for the polls, there can be no changes thereafter as the Rajya Sabha election is governed by the Election Commission.
Stating that the Election CommissionÂ’s rule is that one who is an elected Member of the Legislative Assembly  has a right to vote in the election, Parrikar said on this count, the order of the Speaker is defective and outside his jurisdiction and malafide.
