The easiest technical solution was to mark the LICENSE as <jar>, it would get copied with the jar to the distribution area. It might be better to add <license> as a modified <jar> that does not get added to the CLASSPATH and doesn't cause PREREQ FAILURES if not present but gets picked up by the jar copy part. I think doing so would fit that requirement.
