I find this too, but I think it generally happens for me when I attach the BS 
to my PC between the time I stop reading the book and when I try to pick it up 
again.

I'm curious, what do you mean by poorly encoded MP3 books? I wouldn't think the 
bitrate would have any effect, but if it's a bug, who knows. :-)
