      I found this information that came from another vendor. This might help 
you with additional support in your investigation on how BEP looks at this 
matter with the ongoing education  for vendors. 
       The following is an excerpt from the federal code of regulations. 
        
      Sec. 395.3 (VI) 
      (vi) "Furnish each vendor a copy of its rules and regulations and a 
description of the arrangements for providing services..." 
      Sec. 395.11 Training program for blind individuals. 
      The State licensing agency shall ensure that effective programs of 
vocational and other training services, including personal and vocational 
adjustment, books, tools, and other training materials, shall be provided to 
blind individuals as vocational rehabilitation services under the 
Rehabilitation Act of 1973 (Pub. L. 93-112), as amended by the Rehabilitation 
Act Amendments of 1974 (Pub. L. 93-516). Such programs shall include on-the-job 
training in all aspects of vending facility operation for blind persons with 
the capacity to operate a vending facility, and upward mobility training 
(including further education and additional training or retraining for improved 
work opportunities) for all blind licensees. The State licensing agency shall 
further ensure that post-employment services shall be provided to blind vendors 
as vocational rehabilitation services as necessary to assure that the maximum 
vocational potential of such vendors is achieved and suitable employment is 
maintained within the State's vending facility program. attempts in reversing 
our BEP's continued decline, for our licensed blind vendors. 
        
      As we can understand from reviewing these two sections of the CFR, it may 
be interpreted that BEP not only is to provide these services as the training 
resources required in the attempt of being self-sufficient. I believe it is a 
mute point that our State Welfare and Institutions Code also requires these 
services by the State.

        Michael,
        I agree with Willie.  Upward mobility is retraining, not necessarily 
just another facility.  It would be good for you as the CVPC Training 
Subcommittee to research this possibility.  An on-line BEP catalog could have a 
list of the available courses for BEP, not just the computer training.   
Vendors requiring some brush-up could seek out what segments they wish in 
refreshing themselves with.  Staff could also use the reference materials for 
objectively performing their evaluations.  This would give a vendor an argument 
that "I am complying with BEP's procedures."
        I believe when Joe Smith left BEP, one of his DOR assignments was just 
such a technology position.  I thought Joe Smith was suppose to seek out new 
equipment and the newest blind techniques. Even if I'm wrong, I'm sure Deputy 
Xavier could give you the current status if there is such a person or division 
within DOR.  It never hurts to try!

              Mike 
              I was thinking. Do you want to know what I was thinking? Well 
I’ll tell you. According to the regulations 7212 .4 in the upward mobility 
section it states BEP is responsible for any education for new technologies 
that would help a vendor to keep up with today’s business environment.. If it 
is important for BEP to provide  the vendors the most up to date information to 
help their business, I think it would be important if BEP either bought some 
computer education classes , CD’s or DVD’s on courses like Excel, Microsoft 
Office and some beginning accounting or book keeping programs. If new students 
were receiving this information shouldn’t the rest of the vendors have that 
same opportunity? Is the only avenue for this education only given by a Rehab 
Counselor or can BEP itself provide this information and opportunity?  I 
wouldn’t think it would be very expensive. Even if BEP through the training 
category could buy the CD or DVD and copy it for the vendors, then BEP could 
issue them out to the vendors who would use them. 
              I was sending this to the Training Subcommittee because I would 
think this committee would be the one that could discuss it and if they feel 
there is value in the idea then they could forward this matter on.  I believe 
this is something larger than what a training conference could provide. This 
would take time for vendors to go through the coerce at their convenience.
