ok so ive narrowed the problem down to something to do with rendering
partials
%p
= render :partial => "/layouts/logo"
and
%p
%pre
:preserve
__ ______ __ ______

|____||__|__||______||____||__|__||__|__|__||______|
give different results
logo.haml is :
%pre
:preserve
__ ______ __ ______
.----.| |--.|__ |.----.| |--..--------.| __ |
| __|| ||__ || __|| < | || __ |
|____||__|__||______||____||__|__||__|__|__||______|
it seems the further absolutely indented the render :partial is, the
more incorrect the top line is.
