ANWAR'S APPLICATION FOR AZIZAN'S SYARIAH COURT
PROCEEDINGS ALLOWED
KUALA LUMPUR, Oct 6 (Bernama) -- The High Court here today allowed
Datuk Seri Anwar Ibrahim's application to obtain the Syariah Court's
proceedings record on Azizan Abu Bakar's guilty plea to charges of
committing khalwat (close proximity) and attempting to have illicit sex.
Judge Datuk Arifin Jaka issued a subpoena on Alor Gajah Syariah Court
registrar for the purpose after deciding that Azizan, the sixth witness in
Anwar's sodomy case, need not be recalled to testify concerning his case in
the Syariah Court.
Azizan and Norhayati Saad, 22, who Azizan later married, were both
sentenced to three months jail after pleading guilty to the two charges
committed on Sept 16 and the couple were also fined a total of RM13,300.
Anwar's defence counsels, Christopher Fernando and Karpal Singh yesterday
applied to recall Azizan on grounds that there was new evidence in the
sodomy case after Azizan was arrested and then convicted by the Syariah
Court.
They said Azizan needed to be recalled to allow the defence to challenge his
credibility.
Arifin today ruled that Azizan need not be recalled in order to have his
credibility challenged and the defence instead only needed to obtain the
proceedings record of Azizan's case from the Syariah Court.
Azizan, 39, is the main witness in the sodomy case against Anwar, a former
deputy prime minister, who is jointly charged with his adopted brother
Sukma Darmawan Sasmitaat Madja.
Anwar, 52, and Sukma, 38, are charged with sodomising Azizan, a former
driver to Anwar's wife at Tivolli Villa, Bangsar, here on a night at 7.45pm
between January and March 1993.
Sukma, a businessman, is also charged with abetting Anwar to sodomise
Azizan at the same place and time.
Hearing then continued with Sukma's lawyer, Jagjeet Singh Deo resuming his
