The opera houses have to pay a rental fee to the publisher if they use rented parts. The opera houses also have to pay royalties to the national authors association (ASCAP, GEMA, SUISA,AKM, etc.) according to the size of the hall & the ticket price structure, no matter the hall is sold out or half empty.
Restaurants usually have an agreement with these societies as have educational or religious societies, to pay a per month or per annum moderate fee. If they do not keep lists of the pieces performed, this fee will go into the big pot of the authors society to be divided among the members according to their otherwise accumulated "points". A producer of an opera works on contract, but does not consequently own a copyright on that production. But if the whole production is rented out to another theatre, he is entitled to receive another fee by the other theatre. But if just another producer copies his ideas, well, he could try to sue him for plagiarism, but the chances for success are very slim. But the chances for success for the plagiarist are also very, very slim. Audiences are quite stupid these days, but not that stupid. ................................................
