(NOT PRESENT) UPON hearing counsel the Court made the following O R D E R The reply affidavit filed on behalf of the respondent - State of Chhatisgarh is taken on record. We have heard learned counsel for the parties at length and carefully perused the record. We SLP(Crl.) No. 4387 of 2011 2 have also gone through the documents filed along with the counter affidavit filed on behalf of the State of Chhatisgarh. Ordinarily, this Court does not interfere with the exercise of discretion by the High Court in the matter of grant/refusal of bail when appeal against conviction is pending but, keeping in view the fact that the co-accused Dr. Binayak Sen has already been granted bail by this Court, we deem it proper to pass similar order. Accordingly, the Special Leave Petition is disposed of with the direction that the sentence awarded to the petitioner shall remain suspended and he be released on bail on furnishing bail bond in a sum of `2 lakhs with two sureties of `1 lakh each to the satisfaction of the trial court.
