Dear Mas Budi,

Saya malah lebih setuju lagi kalo semua perizinan pertambangan kembali
diambil oleh pemerintah Pusat (melalui BUMN-nya). Biar tidak ada lagi
kasus tumpang tindih dan kapling2 lahan.
Tapi tentunya perangkat di Pusatnya dibenerin lagi via clean government.
Atau mungkin untuk klasifikasi tambang strategis tertentu, seperti
hidrokarbon (cair, gas, solid) karena menyangkut hajat hidup banyak
semuanya dihandle Pusat saja biar power plan kita nggk ngerasa shortage
supply-nya. Terus yang berbau logam mulia dan base metal lainnya juga
diambil Pusat.
Jadi hanya tambang galian C and air tanah aja yang ditangani daerah.

Emang bener sih peraturan UU yang lama itu udah bener2 bagus, cuman
gara2 OTDA ini akhirnya semua minta jatah....(nah mulai lagi deh benang
kusut ini agak bisa terurai)

Jadi udah ada 2 nih starting point yang bisa kita pakai buat ngebenerin
negara kita ini:
1. Hapus total subsidi BBM (seperti yang kemarin kita diskusikan)
2. Segera keluarkan UU Tambang yang baru, dimana semua perizinan bahan
galian strategis ditarik lagi ke Pusat dan semua perizinan dilakukan
melalui BUMN yang ada.

Yaahh.., kalau bicara soal luasan (acreage) KP/KK/PKP2B/KUD sekarang ini
memang betul2 ndak jelas! Ada je! KP yang diterbitkan oleh daerah sampai
50,000 ha! (lha koq bisa? ya jelas biisaa! wong ini kita di republik
persilatan...). Padahal kalau dilihat dalam aturan tambang yg saat ini
msh berlaku yaitu PP No. 32 tahun 1969 sebagai ketentuan pelaksanaan UU
No. 11 tahun 1967, luas wilayah KP Penyelidikan Umum  tidak boleh
melebihi 5,000 Ha. Lha ada lagi, namanya KUD aja bisa bertindak seperti
grup konglomerasi dengan memiliki buaanyaak konsesi yang kemudian
dikerjakan dg cara SPK-SPK an sama kontraktor tambang, yang dalam hal
ini yang terjadi adalah sangat sedikit pola seperti ini bisa
memperhatikan (bertanggungjawab) soal lingkungan dan reklamasi pasca
tambang.

Terus, kapan UU Pertambangan akan disahkan? wah ini..ya urusan
persilatan lagi! Setahu saya, proses penggodokan UU Pertambangan yang
baru untuk menggantikan yang tahun 1967 ini sudah dimulai sejak akhir
tahun sembilanpuluhan, bahkan (sepertinya) lebih duluan masuk agenda
dibandingkan dengan UU Migas (no. 22/2001), tetapi kenapa sampai
sekarang cuman isu2 aja akan segera disahkan? Apa kurang sajennya di DPR
kali yaa..? Terus terang banyak yg nunggu tentang kepastian hukum di
pertambangan saat ini, suatu peraturan yang bisa dihormati oleh semua
pihak, supaya kita bisa juga dihormati sebagai republik yang bisa
menghormati peraturannya.

PS. Aturan yg dulu sih sebetulnya oke, ada klasifikasi KK, PKP2B (utk
batubara), KP, KUD dan Pertambangan Rakyat, yang digolongkan sebetulnya
berdasarkan pemodalan kerja, teknik pengelolaan tambang, maksimum
revenue and benefit yang diharapkan RI dll, yg kemudian dibagi2 luasan
areanya dan juga sudah banyak dibuat rambu2 aturannya. Mudah2anlah,
nantinya UU Pertambangan yang baru ini (entah kapan terbitnya?) adalah
suatu aturan yang menyempurnakan. Dan yang penting, ada memuat siapa
yang menjadi polisi di aturan tersebut, jadi dikelola dari pusat atau
otoda, kalau jelas siapa (yang credible) yang akan nyemprit dan kasih
tilang tentunya aturan tsb bisa jalan..mudah2an..
