I'm not a lawyer, but I live with them.

As a blanket rule, in the U.S., if communication is work-related (which
includes using work facilities e.g. phones, computers, networks, fax
machines) that communication is owned by work.  Your phone calls, your
e-mails, your IMing.  All belong to the boss.

Last I heard, it wasn't a gray area.  Other countries are definitely
different.
