I have trawled through the Indiana discuss mailing list for a prior answer on this subject and haven't found anything, forgive me if I am replicating here.
If Indiana is to be redistributable the trademark issue needs to be sorted out, from where I stand I see the two options if we want to avoid trouble 1.) Sun licenses the OpenSolaris trademark in a more liberal fashion. Probably not likely as it would potentially dilute the Solaris brand. 2.) Indiana is used as a trademark on the distribution and licensed under something similar to Debians Open Use License: http://www.us.debian.org/logos/ I guess this is something that Sara would be charged with taking care of.
