Some of you e-mailed me asking if you were required to take some immediate action on the new law. Here's information from my colleagues in New York which describes that you do NOT have to take any immediate action. | | | | Please call me if you have questions. | | | | Update on the New CIPA Requirement: | | | | Last October, a new law was enacted, entitled in part "Protecting Children in the 21st Century Act," which imposed an additional CIPA requirement for E-rate applicants' Internet Safety Policies. Under this Act, policies must include "... educating minors about appropriate online behavior, including interacting with other individuals on social networking websites and in chat rooms and cyberbullying awareness and response." | | | | Recently, applicants have reported receiving e-mails from a company selling Internet safety and compliance packages. The company suggests that applicants are at immediate risk of losing E-rate funding if they are not already complying with the new requirement. The FCC, on the other hand, has not yet provided guidance on either the timing or substance of the new requirement. We understand that the FCC is preparing to issue a Notice of Public Rulemaking ("NPRM") later this year as a prelude to developing revised CIPA regulations. Until this occurs, we see little risk of E-rate applicants being held liable retroactively. | | | | We do recommend, however, that applicants who are currently writing or rewriting their Internet Safety Policies plan to incorporate a basic component dealing with online behavior education.
