Actually, I mean quite the opposite. Companies negotiate the ability to reincorporate joint IP back into their stacks. Quite attractive for companies, not Sun, since they have the ability to retain joint IP. But less viral depending on each person's definition of the word. Moreover, perhaps this discussion is orthogonal to the point of a good ITU technique to help others reincorporate new drivers into the install image.
