It's different. The test is specifically for S10, and it's only on S10 that you want to replace existing files. S8 & S9 do not include IP Filter. If there's nothing to replace, there no risk writing directly in /usr/sbin rather than /usr/sbin/i86. The packaging actually takes care of that.

And it wouldn't be efficient, even if it worked. IP Filter is improving by using the new API introduced in the latter version.

But this is an optimization issue. It doesn't really matter. You can optimize your build for your specific processor, and still put it in an i86/ subdir.

I am in the same boat here. Plus I have Solaris 8 to contend with.

I can't check anymore, but I think it'd work there.
