I'm not sure this assumption is valid. 

Note that in DHCPv4, nodes are also supposed to see if someone else is
already using the address before using. This is to prevent duplicate
assignments that "aren't supposed to happen".  Hence, checking to see
if it is in use is a prudent safety measure.
