I guess if you are going to break the laws...break them all. Let's see, a pirate on the air without a license (however, the FCC would not issue them one anyway, so why not do it?), second selling ads is not legal on an unlicensed station, but going back to the first point, you already are breaking the FCC rules by being on the air anyway. Then there is the issue of paying royalaties to BMI, ASCAP, etc, but you should not be on the air anyway. Forget all of the rules, just move your station out in International Waters like Radio Hauraki did for so many years. But the Haitian pirates on the X Band in New England have operated without any issues for years now. Why hasn't the FCC shut them down?
