How about putting it in as a conditional compile so we don't have to track
the patch until 4.0? I'm looking forward to trying it also

It's already run-time conditional -- if you set newi2c to 0 (top of ivtv-driver.c) then it will use the old i2c-bit-algo method by default. However given that Hans is aiming for this weekend for a feature freeze, I would think that this is too soon to allow adequate testing to ensure that the old behaviour really is retained.

It's still running well for me, I've had 16 hours so far without any I2C issues prodding the IR chip. But that's only one data point :)
