<Disclaimer>My knowledge of this is almost none. So if I am completely wrong please correct me!</Disclaimer>. Looking at what cgms-a (Copy Generation Management System) is, I do not think this is implemented in the driver. However ivtv supports capturing vbi so I assume you should be able to capture the data. But I doubt there is free software actually using the data being sent to prevent/allow/etc copying.
