I was not actually referring to a specific guideline, but that is how it was stored in my head about Apache releases :-). After seeing the guideline docs you shared, I found this [1], in which, under the section on NOTICE file it states that LICENSE and NOTICE should be on the top level dir.
However I do not think it is a hard and fast rule, so it may not block the release. OTOH, I think it is generally a good practice to have the LICENSE and NOTICE files in a standard place (otherwise somebody can hide it some where down the folder structure and say that "I satisfy the requirements" ;-) ) May be we should consult legal@ ?? Given that we are fixing it for the next release, I think we can go ahead with the release.
