How about:

or

I'd say they first deals very explicitly with use or deployment,
and the second is something I'd definitely want someone to agree to before
they used the product.
Now, if everyone feels that's inappropriate, I'll be happy to
change the license flag to optional or something. But we never show a "if
you click this download like you are agreeing to the terms of the license"
message or anything, so I don't think it's too obnoxious to reproduce it
at runtime. Anyone else want to chip in here?
