ok, better - I went back to the wiki and release notes just to make sure I am not a complete idiot, and the way I read this:
"In JBoss 4.0.4 we switched the J2EE web services stack from our Axis based version..." (http://wiki.jboss.org/wiki/Wiki.jsp?page=JBWS404Compatibility) and, this from the release notes: "JBoss webservices updated to the new JBossWS stack" There is nothing about selecting ejb3 profile, I would suggest the docs need to make this a bit more clear.
